What are the Main Features of the Scheme?

As a Health Professional you can be held legally liable for loss or damage to other people’s property, injury caused to them, or financial loss alleged to have been caused to your clients or patients, or other parties. This policy will meet that need and provide other important covers and services as well.

The insurer for this policy is Novae Insurance Company Ltd.
We have chosen this insurer as they specialise in Malpractice policies for Health Professionals and we have a specialised improved wording with them. Their premiums are reasonable and their claims department is very good.

This policy has an excess of £0.

The policy is on a claims made basis. There are two different policies on the market at the present time:

CLAIMS OCCURRING: a type of policy (usually Public or Civil Liability wording) where a claim is agreed to be triggered by the date the incident was alleged to have taken place. There is no need to keep a policy going after retirement or when changing to another policy. You are locked into that type of wording, and any claim will be based on the cover and amount which was in force at the time of the incident which is alleged to have occurred, however long ago that may be.

CLAIMS MADE: Most professionals have this type of policy. It covers you when a claim is made known to you, not when it is said to have occurred. When retiring or ceasing the policy, you need to ensure that any new carrier will pick up the previous period insured, or that you purchase at a reduced premium some “ Run Off “ cover. Cover can be backdated, if for example you accidentally missed your renewal date (please note that although we can backdate your cover if you are late renewing by no more than one month, no cover will be in place for current or previous years work performed until we receive your renewal papers). Cover can be updated and improved each renewal for current and previous work performed. Any claim made after the update will be dealt with under the wider cover, even though it may have taken place in a previous year.

What does my policy cover?

• Unlimited Retroactive Cover for previous work performed – no charge if joining from other schemes.
• Wide definition of cover is clear and is not restricted to treatment only.
• Covers full Professional Indemnity (financial loss cover, where no injury has occurred), Medical Malpractice, Public Liability and a legal expenses package.
• This policy is for Reiki only or multi-therapy if correct premium paid. This means that the policy will cover most therapies subject to suitable qualifications. We may need some information on a therapy if we have not heard of it before and some higher risk therapies may incur a premium loading. Please see the attached therapy sheet for details. If your therapy is not on the list, please put it on and we will contact you if we need further information or if an additional premium is required on receipt of your proposal.
• Unlimited run-off for members in event of Death, Permanent Disability or Permanent Retirement provided that the scheme remains with Novae. We will need to be informed prior to any Run Off cover being granted.
• 1 year free run-off for temporary cessation of work.
• Covers Breach of Confidentiality & Libel/Slander, Voluntary Work & Good Samaritan Acts.
• Products Liability (defective products innocently supplied to non-patients up to an annual turnover of £5,000 and unlimited to patients) included at no additional cost.
• Temporary work abroad is covered at no additional charge, provided you live in the UK and underwriters approve
  (maximum of 30 days within each insurance year excluding USA and Canada).
• We include a legal expenses and help lines package (claims occurring policy). The cover is generous and the exclusions few. There follows next some of the salient features of this….
  • Wide range of free 24 hour Advice lines, including Legal Advice on any matter and UK Law Tax advice.
  • Counselling Helpline.
  • Jury or Witness Service Compensation up to £100,000 per claim.
  • Defence of your legal rights following Criminal Proceedings £100,000. This will include legal costs to defend any allegations of sexual impropriety / assault arising from your therapy practice immediately (not only after acquittal), as well as Data Protection and other legislation cover, wrongful arrest, actions against you for unlawful discrimination etc.
  • Negotiation and representation (even including accountants fees) up to £100,000 in event of Inland Revenue full enquiry. PAYE and Social Security Regulations Cover is also included. (Insurers find that their average small claim for a tax investigation is £7,000). Business Assistance Helpline for emergencies involving your premises.
